A 22-year-old college student told a magistrate’s court here that she was kissed and her private parts groped by a man at a carpark in Beach Street last July.
The student, a part-time waitress then, claimed that former Penang Municipal Council councillor L. Prem Anand, 50, also pulled out his private parts and asked her to use her hand or mouth on his genitals.
She said she refused and alleged that the accused then used his own hand to “play” with his genitals during the July 6 incident at about 11.30pm.
She felt liquid on her leg moments later.
The student, whose name was withheld to protect her identity, was testifying during the examination-in-chief by DPP Mohamad Shafiq Mohd Sazalli at the trial of Prem Anand, who is also a former aide of a DAP assemblyman.
He claimed trial last July to using criminal force to outrage the modesty of the student, who was 21 then.
The incident took place at a parking lot of an entertainment outlet in Beach Street.
The offence carries up to 10 years in jail, a fine, whipping or any two of the three punishments, upon conviction.
In her testimony in court, the student said it was her first day at work as a waitress and identified Prem Anand who was in the dock.
She said the incident happened when he asked her to accompany him to the carpark to get his car.
“I cried in the toilet after that and called two of my friends and told them what happened.
“My colleague came to check on me and brought me back into the shop,” she said, adding that she then lodged a police report.
Counsel E. Gnasegaran, who represented Prem Anand, then asked the student during the cross-examination if a second police report on July 11 was lodged after she had discussed the matter with her parents and a politician from Parti Cinta Malaysia (PCM).
She replied “yes”.
Asked if she lodged the second report with a draft prepared after a discussion with her parents and PCM, the student also said “yes”.
Asked if she had checked the status of her first police report before considering the necessity of lodging the second report, she replied “no”.
She also agreed when asked if a press conference with the media was held on July 14 with PCM.
The hearing before magistrate Jamaliah Abd Manap continues on March 27.
Prem Anand was also represented by S. Rethinakumar and Audrey Wee Li Ye.
